A man in his 30s lost his life in a fatal bicycle accident in Las Flores near Mission Viejo this week. On Monday afternoon the California Highway Patrol (CHP) was called to an accident scene on Oso Parkway between Mission Viejo and Rancho Santa Margarita early in the afternoon. A bicyclist (who was pronounced dead at the scene) had been struck by a white pickup truck. The driver of the pickup truck remained at the scene and cooperated with the investigation.
There is no initial evidence of a DUI or that distracted driving on the part of the pickup driver actually caused the accident.
The fatal bicycle accident in Las Flores Near Mission Viejo is tragic. Motorists here in Mission Viejo are required to avoid contact with pedestrians and bicyclists at all costs. The human body is simply no match for the weight and momentum of a car, pickup truck or other motor vehicle. It may take CHP a while to establish what happened in this tragic accident. However, the family of the bicyclist should consider a wrongful death action.

The family of the victim in a wrongful death case can never replace the loss of their loved one. California law provides compensation for the negligent loss of life these cases. The family can recover financial compensation for the loss of the time, activities and special moments they would have enjoyed in the future. If the bicyclist was the provider for a family, the family may seek compensation for the loss of his income, as well as any suffering he may have endured and final expenses.
