Woman Killed in Lake Forest on Christmas Day Accident as Family Followed Behind Her

A 78 year old woman was injured in a fatal accident in Lake Forest on Christmas Day, as her family followed in the car behind her.  The accident occurred around 7:15 PM on El Toro at Glenmeadows Drive.  The woman’s car was involved with another car in an accident that is still under investigation.  The damage to her driver’s side door was so extensive she was pinned in the car, and had to be extricated by firefighters at the scene.  She was removed to Mission Hospital Regional Medical Center, where she later passed away. The driver of the other vehicle was not injured. If the other vehicle is determined to have caused the accident or played a significant role, the family of the woman would have a wrongful death claim under California law.  Our thoughts go out to the family of the Mission Viejo woman, as they grieve her loss

Fatal Accident on 91 Freeway at the 57 Kills One, Injures Another

A fatal accident on the 91 Freeway at the connector to the 57 near Fullerton early this morning claimed one life, and injured another person.  A black Toyota sedan lost control while attempting to exit off of the 91 Freeway onto the 57, and lost control hitting a guard rail and then a light pole.  A 25 year old Anaheim man was ejected from the vehicle during the accident and passed away at the scene.  A 26 year old Anaheim man was taken to UCI Medical Center in Orange with serious injuries. Even though this was a single car accident, the passenger can file a lawsuit against the driver to recover for their injuries.  If the victim who was fatally wounded was the passenger, the family of that man may have a wrongful death action against the driver of the vehicle.  My name is Rivers Morrell and after more than

Anaheim Man Injured on Bush Street Dies Later at UC Irvine Medical Center

An Anaheim man injured on Bush Street in the early hours this morning was rushed to the UC Irvine Medical Center, where he succumbed to his wounds.  Fatal accidents and injuries caused by the negligence of another in California can result in a wrongful death case against the person who caused the accident.  For example, when a DUI driver causes an accident that results in the death of another driver or passenger, the family of the deceased victim can bring a wrongful death action against the DUI driver. Another example of wrongful death occurs when a pedestrian or bicyclist is struck and killed by a motorist.  Fatal pedestrian and bicycle accidents are unfortunately becoming more common here in Southern California.  The combination of the beautiful weather and the number of people out and about enjoying the amenities of the area lead to serious accidents between motor vehicles and pedestrians or

California Loss of Consortium Cause of Action

Recently, a case came up where a man was badly injured due to an accident. Unfortunately, his injuries permanently affected his ability to carry out activities of daily living. It was clear to me that his injuries had taken a toll on his wife. Even though his wife was not involved directly in the accident, I advised her that she may want to consider and bring a claim for loss of consortium. In California, there is a recognizable cause of action for loss of consortium for the spouse and/or registered domestic party of the injured party. California does not recognize a loss of consortium claim for parent/child. Cohabitants of the injured person do not have a viable claim either. In California, the loss of consortium is defined a claim for the loss of love, companionship, comfort, care, assistance, protection, affection, society, moral support and/or the loss of the enjoyment of sexual

Fifth Victim of Fatal Accident in Ontario Was a Huntington Beach Man

The fifth victim of a fatal accident in Ontario was a Huntington Beach man.  Last week, a fatal accident off of the I-10 in Ontario occurred when a Toyota Yaris experienced reported mechanical problems and tried to exit the freeway, broadsiding a Toyota Solara.  The Huntington Beach man was one of the four people traveling in the Solara that was heavily damaged by the impact.  All four of the vehicle’s occupants were killed in the accident.  A 7 year old boy in the Yaris was seriously injured in the accident, and passed away later at a local hospital. Driving under the influence has been ruled out as the investigation into the accident continues.  The driver of the Yaris reported that the accelerator stuck, and she could not slow the vehicle down.  She tried to exit the freeway at the Vineland off ramp, but ran into the Solara as she exited.

Fatal Car Accident Crash in Anaheim

A fatal car accident in Anaheim occurred last week on the 91 freeway near the 57 freeway junction in the city of Anaheim.  The accident occurred in the early morning when a black Toyota vehicle travelling on the 91 freeway lost control, overturned and strike a guard rail. One of the occupants of the vehicles was ejected from the vehicle as a result of the crash and was pronounced dead at the scene. The other occupants of the vehicle were transported to local area hospitals for treatment of their serious, but non-life threatening injuries. Tragic accidents like this are a firm reminder on the dangers of driving, and the importance of proper automobile safety. The most important safety rule is to always wear a safety-belt at all times. Proper usage of a safety belt can help to prevent fatalities like the one above, where the occupant was unfortunately ejected from
