Woman Killed in Lake Forest on Christmas Day Accident as Family Followed Behind Her

A 78 year old woman was injured in a fatal accident in Lake Forest on Christmas Day, as her family followed in the car behind her.  The accident occurred around 7:15 PM on El Toro at Glenmeadows Drive.  The woman’s car was involved with another car in an accident that is still under investigation.  The damage to her driver’s side door was so extensive she was pinned in the car, and had to be extricated by firefighters at the scene.  She was removed to Mission Hospital Regional Medical Center, where she later passed away. The driver of the other vehicle was not injured. If the other vehicle is determined to have caused the accident or played a significant role, the family of the woman would have a wrongful death claim under California law.  Our thoughts go out to the family of the Mission Viejo woman, as they grieve her loss

Fatal Accident on 91 Freeway at the 57 Kills One, Injures Another

A fatal accident on the 91 Freeway at the connector to the 57 near Fullerton early this morning claimed one life, and injured another person.  A black Toyota sedan lost control while attempting to exit off of the 91 Freeway onto the 57, and lost control hitting a guard rail and then a light pole.  A 25 year old Anaheim man was ejected from the vehicle during the accident and passed away at the scene.  A 26 year old Anaheim man was taken to UCI Medical Center in Orange with serious injuries. Even though this was a single car accident, the passenger can file a lawsuit against the driver to recover for their injuries.  If the victim who was fatally wounded was the passenger, the family of that man may have a wrongful death action against the driver of the vehicle.  My name is Rivers Morrell and after more than

Anaheim Man Injured on Bush Street Dies Later at UC Irvine Medical Center

An Anaheim man injured on Bush Street in the early hours this morning was rushed to the UC Irvine Medical Center, where he succumbed to his wounds.  Fatal accidents and injuries caused by the negligence of another in California can result in a wrongful death case against the person who caused the accident.  For example, when a DUI driver causes an accident that results in the death of another driver or passenger, the family of the deceased victim can bring a wrongful death action against the DUI driver. Another example of wrongful death occurs when a pedestrian or bicyclist is struck and killed by a motorist.  Fatal pedestrian and bicycle accidents are unfortunately becoming more common here in Southern California.  The combination of the beautiful weather and the number of people out and about enjoying the amenities of the area lead to serious accidents between motor vehicles and pedestrians or

Fifth Victim of Fatal Accident in Ontario Was a Huntington Beach Man

The fifth victim of a fatal accident in Ontario was a Huntington Beach man.  Last week, a fatal accident off of the I-10 in Ontario occurred when a Toyota Yaris experienced reported mechanical problems and tried to exit the freeway, broadsiding a Toyota Solara.  The Huntington Beach man was one of the four people traveling in the Solara that was heavily damaged by the impact.  All four of the vehicle’s occupants were killed in the accident.  A 7 year old boy in the Yaris was seriously injured in the accident, and passed away later at a local hospital. Driving under the influence has been ruled out as the investigation into the accident continues.  The driver of the Yaris reported that the accelerator stuck, and she could not slow the vehicle down.  She tried to exit the freeway at the Vineland off ramp, but ran into the Solara as she exited.

Fatal Car Accident Crash in Anaheim

A fatal car accident in Anaheim occurred last week on the 91 freeway near the 57 freeway junction in the city of Anaheim.  The accident occurred in the early morning when a black Toyota vehicle travelling on the 91 freeway lost control, overturned and strike a guard rail. One of the occupants of the vehicles was ejected from the vehicle as a result of the crash and was pronounced dead at the scene. The other occupants of the vehicle were transported to local area hospitals for treatment of their serious, but non-life threatening injuries. Tragic accidents like this are a firm reminder on the dangers of driving, and the importance of proper automobile safety. The most important safety rule is to always wear a safety-belt at all times. Proper usage of a safety belt can help to prevent fatalities like the one above, where the occupant was unfortunately ejected from

Could El-Nino Weather Result in More Fatal Accidents?

A recent climate related report showed that economists have associated good weather with heavier traffic and increased incidence of fatal accidents and injury.  Another recent study related the impact of inclement weather on traffic conditions, accidents and fatal injuries.  So what does that mean for those of us who live and work here in Southern California?  We usually enjoy some of the best weather in the nation, dominated by sunny skies and dry roads.  The El-Nino patter will bring waves of heavy rain, thunderstorms and high winds.  There is an increased risk of fatal accidents and injuries as our drivers encounter inclement weather creating slippery roads and reduced visibility. However, after more than 40 years of experience as an accident and injury attorney locally, I can tell you that the greatest increase in serious and fatal accidents is due to distracted driving and cell phone use.  It only takes a moment for

Fatal Car Accident on the I-5 Freeway in city of Tustin

A young woman was killed when she was ejected from a vehicle during a fatal car accident that occurred in Tustin on the I-5 freeway.  The deceased party was a passenger in a Honda Civic that was driving on the southbound I-5 near the First Street exit, when the driver of that vehicle collided into the back of a big rig truck. The accident caused the passenger to be ejected from the Honda and unfortunately, she expired from her injuries. The driver of the vehicle was taken to Orange County Global Medical Center located in the city of Santa Ana with severe injuries as well. Our thoughts and prayers go out to the injured and deceased party in this accident. There is no amount of compensation that can restore you to full health after a serious accident like the one above. Likewise, there is no amount of compensation that can bring

Doctor Loses Life in Fatal Head On Collision on Ortega Highway Near Lake Elsinore

A 59 year old doctor was travelling eastbound on Route 74, often referred to as the Ortega Highway near Lake Elsinore, when his SUV was struck in a fatal head on collision with a Chevy Camaro who evidently crossed the center line while attempting to pass another vehicle.  The incident happened near a popular establishment on a twisting narrow 2-lane section of road clearly marked with a double yellow line down the middle.  Witnesses told CHP the Camaro was attempting to pass another vehicle and pulled into the path of the doctor’s SUV. The driver and a passenger in the Camaro suffered serious injuries including a punctured lung and broken legs and an arm for the driver, and a fractured lower back for the passenger.  The incident continues to be under CHP investigation, and witnesses are requested to contact the CHP Temecula Office 951-506-2000. If the facts in this case hold

DUI Driver Who Caused Wrongful Death of a 6 Year Old Girl Hears Verdict Soon

A mother and her two young daughters were crossing the street in Santa Ana in 2012 when a woman who tested 3 times the legal limit ran a red light and hit the family.  The DUI driver was also traveling at twice the posted speed limit, and the accident unfortunately resulted in the wrongful death of a 6 year old girl. The criminal case for the DUI is coming to a conclusion in the next week or so.  Unfortunately, the family of the 6 year old fatal accident victim has another legal step which immediately follows the criminal case.  In California, if you negligently cause a fatal accident you can be held financially liable for the wrongful death of the victim, as well as injuries to the survivors.  While a lot of this will depend upon the insurance of the driver, these cases can be quite challenging for the family
