Fatal Accident on the 91 Freeway Claims Lives of Father and 2 Young Children

A rear end fatal accident involving a commercial truck has taken the lives of a father and two of his children.  The fatal accident on the 91 freeway occurred early in the morning hours.  A commercial gas tanker truck ran into the back of a red Jeep causing the vehicle to lose control.  The Jeep veered into the median where it became involved with another vehicle.  This second collision caused the Jeep to overturn where it was immediately run into by a third vehicle (a BMW sedan).  All three of the occupants of the Jeep lost their lives. The facts portrayed by the California Highway Patrol or CHP in this case have the hallmarks of a wrongful death action.  A commercial truck caused an accident that directly led to the wrongful deaths of those in the Jeep.  My name is Rivers Morrell and after more than 40 years of experience

Can a Passenger’s Family Sue the Driver for a Wrongful Death?

Can a passenger’s family sue the driver for a wrongful death after a fatal car accident?  Absolutely.  In California, a wrongful death occurs whenever someone loses their life due to the negligence of another driver.  They don’t have to be in different vehicles.  If the victim is not in the immediate family of the driver a wrongful death action should be brought on behalf of the victim’s family. These cases can be quite trying for the family.  My name is Rivers Morrell and after 40 years of experience with wrongful death cases I can tell you it take endurance for the family of those who are lost.  Especially when the driver who is responsible faces criminal charges such as a Fatal Felony DUI or vehicular manslaughter.  The criminal case should be completed before the family pursues the civil and financial case of wrongful death.  This allows facts to be established by

Under Paid Employees Part of Nursing Home Injuries and Falls Challenge

Under-paid employees play a significant role in the number of nursing home injuries and falls each year in California.  CDC statistics show hazardous levels of risk in California retirement homes.  Recently, a CDC study noted that for every 100 beds in nursing homes and assisted care facilities, there were 100 to 200 falls each and every year.  That’s 1 to 2 falls per bed per year.  The risk of serious injury and fatal injury is much higher in senior citizens, as 20% of accidental deaths each year in this age group are attributed to falls in nursing homes.  According to the CDC the average number of falls per year is 2.6 per person.  Most of these injuries are to patients who are unable to walk freely on their own. Recent headlines about local nursing home employees joining fast food employees asking for higher minimum wages brings this issue into specific

Santa Ana Pedestrian Killed in Crosswalk in Garden Grove

A Santa Ana pedestrian killed in a crosswalk in Garden Grove was a 51 year old woman.  The driver of the pickup truck who caused the accident was not cited or taken into custody.  There is a question as to whether the pedestrian was physically within the crosswalk when the fatal accident occurred, and the driver of the pickup did stop, provide assistance and remain at the scene. It was 10:00 pm on a Friday night, but alcohol and drugs do not appear to have been a factor in the accident.  The legal question is whether the death of the pedestrian is a “wrongful death” under California law.  The lack of a police citation (ticket) has no legal bearing in these matters, as wrongful death is a civil and financial action, not a criminal case.  The legal question will focus on whether the driver of the pickup actually caused her

The Family of a Man Lost in a Fatal Dana Point Accident May Have Wrongful Death Claim

A man driving a Chrysler Coupe was broadsided by a Cadillac Escalade at the intersection of Golden Lantern Street and Selva Road.  Unfortunately the driver of the Chrysler Coupe did not survive the fatal accident, and the driver of the Escalade was transported to a local hospital with minor injuries.  Accidents at an intersection are often quite violent, resulting in serious injury and in some cases loss of life.  The question in this case is which vehicle was responsible for the crash?  If a fatal accident was due to another driver’s negligence, the family of the victim may file a wrongful death claim in California. If the Escalade was at fault for the accident, the family of the man driving the Chrysler Coupe should consider a wrongful death lawsuit against the driver of the Escalade.  California law recognizes the value of a person’s life, and the loss of “consortium” (the ability to

A mother and her two young daughters were crossing the street in Santa Ana in 2012 when a woman who tested 3 times the legal limit ran a red light and hit the family.  The DUI driver was also traveling at twice the posted speed limit, and the accident unfortunately resulted in the wrongful death of a 6 year old girl. The criminal case for the DUI is coming to a conclusion in the next week or so.  Unfortunately, the family of the 6 year old fatal accident victim has another legal step which immediately follows the criminal case.  In California, if you negligently cause a fatal accident you can be held financially liable for the wrongful death of the victim, as well as injuries to the survivors.  While a lot of this will depend upon the insurance of the driver, these cases can be quite challenging for the family
