Premises liability is a sub-set of personal injury cases which involve those who suffer preventable injuries at a commercial business or residential property.  California law requires business owners and those who own and manage publicly accessible residential property such as apartments or nursing homes to keep their property free from the types of hazards which could cause injury for their customers or guests.

In strong premises liability cases the business owner or property manager failed to prevent or remedy hazards they were aware of or should have been aware of.   For example, if a product falls off of a store’s shelf and strikes a child in the head it is considered to be a premises liability related personal injury case.  Some of the types of premises liability cases our firm has successfully represented in the past include but are not limited to:

Slip and Fall Injuries – if you are injured in a fall in or around a property it is often referred to as a slip and fall case.  Generally speaking, California law requires property owners to promptly address risks they become aware of or should have known about.  In one case, our client was injured on a handicap ramp which was uneven.  In another, our client was injured after falling and suffering a knee injury in a grocery store.  Video tape from the store itself as well as supporting maintenance records clearly demonstrated the failure of the store to properly and regularly inspect the facilities and remedy the risk which resulted in injury.

Dog Bites – in California, the dog’s owner is “strictly liable” for injuries which result from a dog bite or attack.  Dog bites can result in substantial liability when a guest, visitor, passerby or even an invited professional (mail or delivery professional) are bitten by a dog.
