Fatal Hit and Run Pedestrian Accident in Orange

We are deeply saddened by the loss of a marine veteran in a fatal hit and run pedestrian accident in Orange recently.  There have simply been too many of these accidents and we should all work to increase our awareness and help to identify those responsible.  The young man who lost his life leaves a daughter less than 2 years old.  The family has established a GO FUND ME page to help raise money for her care and support.

This family has suffered what is known as a “wrongful death” in California.  My name is Rivers Morrell and after more than 40 years of experience in these cases I can tell you it still shocks me when hit and run drivers leave injured victims and drive away.  The family will have two years under California law to identify the party or parties responsible and hold them financially accountable in a civil lawsuit for the loss of their beloved son and father.  Usually, the wrongful death case would await the outcome of the criminal matter as the the criminal charges resulting from this event and a resulting conviction all but seal the outcome of the civil lawsuit.

What happens if the hit and run driver is never identified?  The family can still recover for the loss of their son through his own automobile insurance.  The Uninsured/Underinsured Motorist or UM/UIM portion of an automobile insurance policy covers injuries and losses experienced by pedestrians in hit and run accidents.  Many of our clients have been surprised in the past when they approach their own insurance company, expecting to be treated “like a good neighbor” or to feel as if they are “in good hands.”  Imagine their disappointment when their own insurance company attempts to dispute their claim or offer an amount which is far below the coverages provided for in the policy.
