STD from a Celebrity in LA without Advance Warning

What should you do if you get an STD from a celebrity in LA without advance warning prior to intimate contact?  Hold them financially accountable and responsible for your present and future medical expenses and the damage to your personal life.  California law requires anyone with an STD to tell a potential partner they carry the STD prior to intimate contact.  The failure to do so opens them to a civil lawsuit, and if it is HIV / AIDS criminal charges. My name is Rivers Morrell and I have extensive experience in STD related cases in LA.  Los Angeles has one of the highest rates of STD cases in the nation, and those who have worked to take precautions have protections under the law.  Most of my clients express hopelessness, brokenness and concern about the power of a celebrity or that it is “their word against mine.”  I can tell

Usher STD Case a Lesson for Recording Artists and Musicians

What makes the Usher STD case a lesson for recording artists and musicians alike?  Recently, many news outlets covered the planned civil lawsuit against Usher for exposing several individuals to Herpes without providing advance warning prior to intimate contact.  California law (and the laws of every state in the nation) require those who have an STD to warn potential partners in advance of intimate contact they have an STD.  Like the recent Charlie Sheen HIV case, the Usher case involves those who have tested positive after an encounter with the recording star.  Mr. Sheen described this as a form of “extortion.”  Nothing could be further from the truth. It is a criminal and civil offense to knowingly carry an STD and fail to provide advance warning to potential intimate partners.  California law provides a criminal path as well as a civil (financial) remedy for the failure to notify a lover

Dating Sites Requiring Members to Self-Test for HIV and AIDS

Recently many dating websites have been marred by the rising incidence of Sexually Transmitted Disease or STD transmission by their members including HIV and AIDS, as well as herpes and HPV.  Major dating sites such as Grindr and others are providing home test kits that allow members to test themselves in the privacy of their own homes for HIV and AIDS.  The kit provided by Grindr included a simple gum swab kit that delivers results in as little as 20 minutes.  The site recommends members who receive a “positive” result should pursue independent testing from their doctor or a lab to confirm or disprove the results. Here in California and in most states of the union it is illegal to transmit an STD without providing advance warning to a partner prior to intimate contact.  The failure to do so exposes partners of substance to a civil liability, allowing victims to pursue

Tomorrow is National HIV Testing Day

Tomorrow, Monday June 27 is National HIV Testing Day.  Los Angeles has experienced rapid growth in the number of reported HIV cases over the past few years according to the Centers for Disease Control or CDC.  National HIV Testing Day is traditionally a day to be tested and to increase the awareness of the spread of the HIV virus, but also an opportunity to have a family discussion about sexuality and the spread of Sexually Transmitted Diseases or STDs. CDC Reports Significant Rise in STD Transmission Cases

According to a recent study released by the Centers for Disease Control or CDC the US is experiencing a rapid increase in the number of Sexually Transmitted Disease or STD transmission cases in recent years.  Three dormant STD’s – chlamydia, gonorrhea, and syphilis – have increased for the first year since 2006.  Herpes continues to be one of the most commonly transmitted STD, with genital Herpes Simplex Virus 1 or HSV-1 significantly increasing in the most recent study – especially in younger demographics. However, the leading STD transmitted in the US continues to be Human Papillomavirus or HPV.  Although most forms of HPV are asymptomatic and resolve within a few years, two types – 16 and 18 – account for 70% of the cervical cancers throughout the world.  The impact of HPV transmission can become life threatening.  While there are vaccines available, they have not seen widespread adoption across American demographic profiles.

Intimidation in STD Transmission Cases Can Result in a Civil Lawsuit

Intimidation in STD transmission cases is quite common, and there is no way you should have to tolerate it.  If you were given an STD by a partner who did not tell you they carried an STD prior to intimate contact you can hold them financially responsible.  In many cases, especially those where the person who transmits Herpes, HPV or HIV is famous, or a person of wealth or substance, subtle threats or intimidation are used in an attempt to keep you quiet. “It’s your word against mine.” “You can’t prove I’m the source.” “You’ve had other lovers, how can you prove it was me?” “I have the best lawyers money can buy….” Don’t listen to intimidation or threats if you have been given an STD without warning.  My name is Rivers Morrell, and for more than 40 years I have protected injury victims, including those who have received an

STD Rates on the Rise Due to Popularity in New Dating Apps?

Many STD’s such as genital herpes (hsv-2), chlamydia, HIV, HPV, and gonorrhea were on the downswing for many years, with lower rates of infection in the general population. However, recent statistics from the Center for Disease Control indicate that this trend is over, and many STD rates are on the rise again.   Many experts have many theories for the rise in STD transmission rates among the population, and one of the explanations focuses on the popularity of new dating apps such as Tinder. New dating mobile applications such as Match.com, Tinder, and Plenty of Fish work to match up potential couples. It is a form of speed dating with many individuals going on multiple dates frequently. As a result of the ease of use, and the huge pool of applicants, experts believe that it has helped to loosen attitudes towards casual sex and encourage promiscuity. In term, this has let

Personal Injury Claims for Sexually Transmitted Diseases

Most people are unaware that there are both criminal and civil causes of action for the knowing transmission of a sexually transmitted disease or STD without warning in the state of California. For instance, if a boyfriend knowingly conceals the fact that he has Genital Herpes and transmits this to his girlfriend, the girlfriend may be able to sue the boyfriend for her damages. Many people are ashamed to bring these types of lawsuits, but they are growing in popularity, and for the right case the damages could be high. The damages in these types of cases can consist of medical treatments required as a result of the infection, the pain and suffering sustained as a result of the shame of having an incurable disease, and the future pain and suffering as a result of carrying this lifelong infection (in the case of Genital Herpes or HIV). Due to the
